Court stops eviction of former Karuturi workers

Employment and Labour Relations Court issued the order following applications by Kenya Plantation and Agricultural workers union accusing the receiver of evicting them and renting out the houses. The employees in their suit claimed that their eviction is in breach of labour laws, arguing that they are still recognis as unsecured creditors of the company.

The receiver of flower farm Karuturi has been restrained from evicting the company’s former employees from its estate pending determination of a case filed by the workers’ union. Employment and Labour Relations Court issued the order following applications by Kenya Plantation and Agricultural workers union accusing the receiver of evicting them and renting out the houses.The employees in their suit claimed that their eviction is in breach of labour laws, arguing that they are still recognis as unsecured creditors of the company.“That a temporary order of prohibition be and is hereby issued restraining the respondents by themselves, their agents, assigned servants and representatives from causing/evicting and or/renting out any of the staff houses belonging to former employees of Karuturi Limited in liquidation pending hearing and determination of this case,” ordered the court.

The union termed the move to rent out the houses as fraudulent arguing that the company continues to exist.The new court case comes even as the owners of the flower farm continue with their battle at the appeal court seeking to stop the auction of their properties by the receiver.The Court of Appeal two weeks ago suspended auctioning until the parties appear in court for hearing of an ongoing case on the matter.This was a reprieve for the owners who have been fighting for years to save the flower firm from the auctioneer’s hammer.The receiver managers on May 2 advertised for the sale of some of the movable assets, which include greenhouse irrigation equipment, generators, cold storage units, farm tools, motor vehicles and IT equipment.
