Court stops Uhuru pick of Muthaura to the KRA board

Justice Byrum Ongaya of the Employment and Labour Court suspended the appointment of Mr Muthura, Charles Makori Omanga, Mukesh Shah, Leonard Ithau, and Susan Mudhune to the KRA board. Activist Okiya Omtatah challenged their appointment by President Uhuru Kenyatta, arguing that their nomination through a gazette notice was not competitive and that some of the appointees are beyond the retirement age of 60.The activist reckoned that Mr Kenyatta’s appointment was in breach of the Constitution because it was not in writing and lacked his signature and presidential seal.

The High Court has stopped the appointment of former Head of Civil Service Francis Muthaura and three others as directors of the Kenya Revenue Authority (KRA) until a case challenging their selection is heard. Justice Byrum Ongaya of the Employment and Labour Court suspended the appointment of Mr Muthura, Charles Makori Omanga, Mukesh Shah, Leonard Ithau, and Susan Mudhune to the KRA board.Activist Okiya Omtatah challenged their appointment by President Uhuru Kenyatta, arguing that their nomination through a gazette notice was not competitive and that some of the appointees are beyond the retirement age of 60.The activist reckoned that Mr Kenyatta’s appointment was in breach of the Constitution because it was not in writing and lacked his signature and presidential seal. He further argued that the president’s decision to hand-pick people to public office is against the law since it is inconsistent with provisions of the Constitution that require the posts to be filled through an open, fair and competitive process. He argues that Mr Muthaura is past the mandatory retirement age of 60 years and cannot qualify unless it’s demonstrated that he has special skills. The case will be heard this morning.

The president, in a special May 23 gazette notice, said Mr Muthaura would serve as director until October 20, 2019. He revoked the appointment of Edward Sambili.Prior to the appointment, Mr Muthaura, 71, served as the Lapsset Development Authority chairman.Mr Uhuru also appointed Mr Shah, Mr Ithau and Ms Mudhune to the KRA board until October 20, 2018.He revoked Mr Abdi Bare Duale’s appointment to that board and replaced him with Mr Charles Makori Omanga, who will serve until June 2020.Mr Duale has been appointed as the new Kenya Leather Development Council chairman for a three-year period effective from next Wednesday.
